MOVING AGREEMENT

Moving Company General Terms and Conditions
Effective from 10.08.2024

1. Validity of General Terms and Conditions

These terms and conditions apply upon signing the Agreement, when the Customer places an order, and when the Moving Company begins providing the service, even without a written contract. By ordering the service, the Customer confirms acceptance of these terms and conditions.

2. Nature of the Service

The Moving Company provides moving and additional related services in accordance with the laws of the Republic of Estonia and the Law of Obligations Act.

3. Ordering and Confirmation of the Service

Orders can be placed via phone, email, or an online form. Orders placed via phone must be confirmed in writing via email, message, or another reproducible format. The confirmation must include order details and Customer information.

4. Cancellation of the Service

For domestic moving services, cancellations must be made in writing (email or message) at least 24 hours before the move begins. If the cancellation occurs less than 24 hours before the scheduled move, the Customer must pay a compensation fee equivalent to one working hour. If the moving crew has already departed, the Customer must pay at least a one-hour fee, plus additional travel expenses for moves outside of Tallinn.

5. Hourly Rate Includes

  • Labor and transportation (size of the moving crew and vehicle depends on the selected service)
  • Furniture assembly and disassembly
  • Packing services (packing material costs are additional)
  • Loading and unloading work Note: Heavy or oversized item moving (special lifts) is not included in the hourly rate.

6. Working Hours and Price List

Services are generally provided Monday to Friday from 9:00 AM to 6:00 PM. Weekend and evening services are available by agreement. The price list applies Monday to Friday from 9:00 AM to 6:00 PM (excluding public holidays). Prices for weekends and outside standard working hours are determined separately.

7. Hourly Rate and Mileage Calculation

Billing starts when the moving crew arrives at the location and ends when the work is completed. For jobs outside Tallinn, billing ends when the moving crew returns to the city’s border. Mileage is calculated for moves where the origin, destination, or both are outside Tallinn. The distance is determined using Google Maps.

8. Minimum Fee and Time Calculation Precision

The minimum fee is based on two working hours unless otherwise agreed. After two hours, billing is calculated in 30-minute increments.

9. Fixed-Price Moving Services

For fixed-price moving services, the agreed-upon price must be paid regardless of whether the work would have been cheaper or more expensive with an hourly rate. The fixed price is based on accurate preliminary information and a defined workload. The Moving Company has the right but not the obligation to provide services at a fixed price.

10. Additional Services

The Moving Company may offer additional services as agreed. Any extra work or services requested by the Customer during the move will be performed if time and resources allow.

11. Payment Terms and Deadlines

  • Individuals: Payment is due immediately after the service, in cash or by card, unless otherwise agreed.
  • Companies and institutions: Payment is due within 5 days via bank transfer, card, or cash after service completion.
  • Government agencies: Payment is due within 21 days via bank transfer after service completion.
  • Partners: Payment terms are based on the cooperation agreement.
  • Installment payments: Available only if an installment agreement is signed before the moving service begins.

12. Payment and Deadlines for Storage Services

Storage fees are billed monthly, payable at the beginning of the month following the storage period. Detailed conditions are outlined in the storage service agreement.

13. Moved Property

The Customer confirms they own the moved property or have the necessary authorization to handle it. The Moving Company is not responsible for verifying ownership and does not intervene in property disputes. If there is reasonable doubt about the Customer’s authorization, the Moving Company has the right to terminate the service and request compensation for costs incurred. If necessary, authorities or the rightful owner will be notified.

14. Moving Company Liability

The Moving Company is liable for damages caused to the Customer’s property or third parties (buildings, office spaces, etc.) during the move. The Moving Company takes full responsibility for the integrity of moved property if it was packed by the company. Liability also includes loss of items. Any claims regarding damaged or missing property must be submitted in writing within seven (7) calendar days after delivery. The Moving Company has the right to request an inspection of the damaged items for expert assessment.

15. Limitations of Liability

The Moving Company does not compensate for indirect damages or lost income. The Moving Company is not liable for damages if:

  • The items were packed by the Customer or a third party (e.g., the contents of Customer-packed boxes, which cannot be inspected externally).
  • The Customer refused or declined packing services (e.g., moving furniture without protective wrapping).
  • Items were previously improperly or inadequately packed.
  • Delays or damages occurred due to force majeure or actions of the Customer or third parties not affiliated with the Moving Company (e.g., damage caused by the Customer or their helpers during loading/unloading).

By ordering the service, the Customer confirms they have read and agreed to these general terms and conditions.
